Insurance- Hit and run?

Im going to try to explain the best I can.
My girlfriends Car was parked in front of our home
We carry the state minimun Liability(ohio). A drunk man with no L’s or Insurance hit totaled her car and Ran luckily he was caught an hour later. We contacted our insurance and they basically said you have to sue him etc. etc.no coverage offered. We cant aford a lawyer or anything. So i called him and asked what we could work out together outside of the court.He claimed “I have no job my son was driving its on him” Is this a good way to go about it or should i just sue him?

You’re going to have to sue him. And even if you win, that doesn’t mean he’ll pay anything. Can’t get blood from a stone, ya know?

Sue the owner of the vehicle, and if he says the son was driving and gives you the info, sue the son as well. It’s going to take several months at least, so I’d do something about that car this weekend.
